COMMERCIAL LAWSUITS |

The following lawsuits involving local businesses have been filed in
Chelan County Superior Court. Plaintiff is listed first. Readers are
cautioned that claims in these actions have not been proven; they are
alleged to be causes for action and their truth will be determined at trial.

France & Co. v. Phil Fox
In November 2006, France & Co. began restoration, remodel and construction of a house and guest house for Phil Fox at his property in Manson. France & Co. maintain that the work was completed within the scheduled time frame agreed upon and up to the proper standard. The construction company claims Fox still owes it $64,500.78 for the project. Numerous attempts to get the money have been unsuccessful. France & Co. are asking for the $64,500.78 paid plus interest and payment for attorney fees. The case was filed in Chelan County Superior Court Aug. 8 by the company’s attorney Blake Allen Martin. No response by Fox has been recorded.

Andre v. Premium Developments LLC

Ronald and Judith Andre are seeking payment on a $100,000 promissory note by Calvin White and Premium Developments LLC. The Andres claim they agreed to lend Premium Developments LLC $100,000 in February 2007 with the understanding it would be paid back within a year. The Andres report Premium Developments made two payments of $10,000 each. In early 2008, the Andre’s and Premium Developments LLC made arrangements to extend the length of the loan with added debt. The Andres are now seeking payment of the original promissory note along with interest, which comes to $115,489. The case was filed in Chelan County Superior Court on July 23 by the Andre’s attorney Roberty Gray Dodge. No response by Premium Developments LLC has been recorded.

Woodridge Construction and Development v. Hamer Homes and Construction

In March 2005, Woodridge Construction and Development bought vacant land in Wenatchee and subdivided it into 24 lots in the Woodridge Subdivision. Woodridge sold six lots for an undisclosed amount to Hamer Homes and Construction in August 2005. As part of the sale agreement, Hamer Homes agreed to build on the lots within 24 months. Woodridge Construction maintains that Hamer Homes has not begun construction on three of those lots as per the contract. It is asking the court to allow it to purchase the lots for the original price Hamer Homes paid in 2005. The case was filed in Chelan County Superior Court Aug. 6 by Woodridge’s attorney Justin Collier. No response by the Hamer Homes has been recorded.

PKJB Architectural Group v. Chelan Landing LLC

In 2007, PKJB Architectural Group entered into a contract with Artisan Development group to design and implement a plan for a development that included pools and a recreation area in Chelan. The contract called for PKJB to draw up schematics, do design development and construction phasing for the project. PKJB was to be paid $429,000 for its services. In May 2008, the project came under new ownership as Chelan Landing and PKJB has not received the balance of the money due for its services, which PKJB mark at $124,264.29. PKJB is asking for Chelan Landing LLC pay the remaining balance plus interest and attorney fees since the company assumed Artisan’s debts and resources on the building project. The case was filed in Chelan County Superior Court Aug. 7 by PKJB’s attorney Thomas Francis O’Connell. No response by the defense has been filed.

TAX LIENS |

A tax lien is a legal claim filed in court by a government agency against a person or business owing taxes. Liens are civil, not criminal claims, and normally seek to attach money and/or property to pay the taxes. A list of liens is kept at the county courthouse showing who the government is pursuing and how much is sought. Liens can be filed for income taxes, unemployment taxes, sales taxes, real estate excise taxes, Social Security or disability taxes. When the tax lien is paid and released, papers are filed with the courts as well, affirming the discharge.
